The license agreement is between Designs for Textiles (hereinafter “DFT“) and the customer (hereinafter “Licensee“).
These license agreements set forth the terms on which Licensee may use the Designs and/or any of the various attachments included herein provided by DFT.
LICENSING AGREEMENTS:
It is important to understand immediately that with the purchase of the designs, the license to use them, and therefore the permission to use them as indicated in the attached license documents, is purchased, so there is no transfer of ownership of the designs and attachments included, which therefore cannot be resold in any form, not even modified.
There are basically 5 different types of licensing contracts depending on the category of design that is purchased. Below is the list:
Standard License
(available for repeatable patterns and textures, materials)
Premium License
(available for repeatable motifs, textures, materials)
Textile Jacquard License
(only available for repeatable patterns)
Designs Jacquard License
(only available for Jacquard Designs)
Vector License
(only available for repeatable patterns)
REPEATABLE PATTERN LICENCES
Standard License (for REPEATABLE PATTERNS)
This License Agreement sets forth the terms of Licensee‘s use of the product purchased from the DFT site.
The license agreement allows the use of the purchased product according to various rules. With the license agreement there is NOT a transfer of ownership between the parties (copyright).
The ownership of the product therefore always remains with DFT.
LICENSE AGREEMENT:
Standard Web-Screen-3D-Print License (personal/advertising use)
Important note: even if the license allows the use in print (for personal/advertising use), given the characteristics of the format designed for screen use, we do not recommend the use of this version for printing, as good quality is not guaranteed. For printing, in case the relative version exists, we strongly recommend the printing license, which includes vector format drawings suitable for this purpose.
MAIN FEATURES:
– NON-exclusive license
– the design remains in DFT’s online library and can be purchased by other customers (licensees).
– the design can be used without any time limitation (there is no expiry date in the license).
– the design can be modified and transformed in any way you wish for personal and advertising use.
– the design MAY be used and is suitable for web – screen and 3D applications, both for personal and advertising purposes, but not for commercial use.
Some examples of use are NOT allowed:
If used as part of a 3D object also of derivatives subsequently offered for sale (video games etc.), If used on online newspapers, etc..
– the design MAY be used for printing for advertising purposes only (e.g. on flyers), but it is not recommended given the Jpg format and the low resolution (for this use we recommend the licensed version for printing).
– the design MAY NOT be resold even in a derivative form of the same (i.e. after any modification or transformation).
– the design MAY NOT be used for commercial purposes, production and/or creation of derivatives containing it in any way (even of a derivative thereof).
– the design MAY NOT be printed for commercial purposes (e.g.: prints on objects, T-shirts that will be resold, magazines, books, logos, etc.). In the case of use in the editorial field, however, it is allowed to use the design in print on the advertising pages of third parties, however, it is NOT allowed if it is part of the graphics on the cover or inside pages.
Printing for personal use is allowed.
Premium License (for REPEATABLE PATTERNS)
This License Agreement sets forth the terms of Licensee‘s use of the product purchased from the DFT site.
The license agreement allows the use of the purchased product according to various rules. With the license agreement there is NOT a transfer of ownership between the parties (copyright).
The ownership of the product therefore always remains with DFT.
LICENSE AGREEMENT:
Premium Web-Screen-3D-Print License (personal/advertising/commercial use)
Important note: Although the license allows for use in printing, given the characteristics of the format designed for screen use, we do not recommend using this version for printing, as good print quality is not guaranteed. For printing, we strongly recommend the license for the print version which includes vector format drawings suitable for the purpose, when available for the chosen drawing).

– NON-exclusive license
– the design remains in DFT’s online library and can be purchased by other customers.
– the design MAY be used without any time limitation (there is no expiry date in the license).
– the design MAY be modified and transformed in any way you wish for personal and advertising use.
– the design MAY be used and is suitable for web – screen and 3D applications, both for personal and advertising and commercial purposes.
Some examples of use for commercial purposes:
If used as part of a 3D object also of derivatives subsequently offered for sale (video games etc.), If used on online newspapers, etc..
– the design MAY be used for printing, but it is not recommended given the Jpg format and the low resolution (for this use we recommend the licensed version for printing).
– the design MAY be used for commercial purposes, production and/or production derivatives containing it in any way. Example: if used on a 3D object that will then be put on sale, it is allowed to be used.
– the design MAY NOT be resold even in a derivative form of the same (i.e. after any modification or transformation), except for the uses mentioned above (as part of other products).
Textiles Jacquard License (for REPEATABLE PATTERNS)
This License Agreement sets forth the terms of Licensee‘s use of the product purchased from the DFT site.
The license agreement allows the use of the purchased product according to various rules. With the license agreement there is NOT a transfer of ownership between the parties (copyright).
The ownership of the product therefore always remains with DFT.
LICENSE AGREEMENT:
Textile license (for any kind of use, from the web, to the production up to the sale of products and derivatives and jacquard fabrics)
MAIN FEATURES:
– NON-exclusive license
– the design remains in DFT’s online library and can be purchased by other customers.
– the design MAY be used without any time limitation (there is no expiry date in the license).
– the design MAY be modified and transformed in any way you wish.
– the design MAY be used and is suitable in various fields, but specifically it has been designed for use in the Jacquard textile industry, thanks to the technical features and file format suitable for the purpose.
– the design MAY also be used in other areas, in addition to Jacquard textiles, both for textile printing, printing on paper or in digital format. However, it is not recommended for direct use for printing as the file format and its dimensions are not suitable for every type of printing.
If you want to use for printing, always having an adequate result, we recommend an adequate processing of the design, or if present on the site, the licensed version for printing, which is specially designed for this purpose.
– the design MAY be used for commercial purposes, production and/or production derivatives containing it in any way.
– the design MAY NOT be resold even in derivative form of the same (i.e. after any modification or transformation), except for the above mentioned uses (as part of other product).
TEXTURES LICENSES
Standard License (for TEXTURES)
This License Agreement sets forth the terms of Licensee‘s use of the product purchased from the DFT site.
The license agreement allows the use of the purchased product according to various rules. With the license agreement there is NOT a transfer of ownership between the parties (copyright).
The ownership of the product therefore always remains with DFT.

Premium License & Premuim Licens PLUS (for TEXTURES)
This License Agreement sets forth the terms of Licensee‘s use of the product purchased from the DFT site.
The license agreement allows the use of the purchased product according to various rules. With the license agreement there is NOT a transfer of ownership between the parties (copyright/copyright).
The ownership of the product therefore always remains with DFT.
LICENSE AGREEMENT:

– the design MAY be used without any time limitation (there is no expiration date in the license).

– the design MAY be used and is suitable for web – screen and 3D applications, both for personal and advertising and commercial purposes.
Some examples of use for commercial purposes:
If used as part of 3D object also of derivatives subsequently put on sale (video games etc.).
– the design MAY also be used for printing.
– the design MAY be used for commercial purposes, production and/or production of derivatives containing it in any way. Example: if used on a 3D object that will be later put on sale, it is allowed to be used.
– the drawing MAY NOT be resold even in derivative form of the same (i.e. after any modification or transformation), except for the uses mentioned above (as a component of other products).
JACQUARD DESIGN LICENCES
Jacquard Designs License (for Jacquard Designs)
This License Agreement sets forth the terms of Licensee‘s use of the product purchased from the DFT site.
The license agreement allows the use of the purchased product according to various rules. With the license agreement there is NOT a transfer of ownership between the parties (copyright/copyright).
The ownership of the product therefore always remains with DFT.
LICENSE AGREEMENT:
Jacquard Designs License (For textile companies)
MAIN FEATURES:
– NON-exclusive license
– the design remains in DFT’s online library and can be purchased by other customers.
– the design MAY be used without any time limitation (there is no expiry date in the license).
– the design MAY be modified and transformed in any way you wish.
– the design MAY be used for production, fabric sampling, i.e. as a derivative product, and the fabric made from the design can be sold anywhere in the world, without any additional clause.
– the design, on the other hand, MAY NOT be resold even in partial or derived form (i.e. after any modification or transformation), except for the above mentioned uses (such as fabric production, fabric sampling, etc.).
– It is welcome, but NOT mandatory, to make known the participation of DFT in the manufacture of the fabric you produce.
Other information valid for all licences
1. Licensing costs
License fees may be subject to any change in price at any time at the discretion of DFT.
2. License purchase terms
The licenses acquired together with the purchased design are valid and active from the date of the document sent by email after the purchase of the design(s).
It is recommended that you keep a copy of the email received as proof of validity of the purchase, although normally the relevant information can be found in the ordering section of the customer account (Licensee) on the DFT website.
The licensee is responsible for any taxes
If the licensee does not use the design, DFT will not be required to take it back or refund the license purchase.
3. Limitation and Exclusion of Liability
Please note that DFT assumes no responsibility for the use of the licensed designs. In general no liability is assumed if such use infringes any third party’s property rights such as trademark rights, copyrights or registered designs, and no liability is assumed if the licensee by their use directly or indirectly creates damage to third parties of a material and/or moral nature.
With regard specifically to the “Jacquard Drawings license”, DFT does not assume any liability for any damages due to improper use of the designs and attachments. Jacquard designs, in case they are certified tested, certify only the absence of technical errors/defects and only in case of use with all conditions perfectly equal (same looms, same yarns, etc.). Therefore the licensee will be the only responsible for any damages (which should not happen with a proper use of the design), for the use of the designs.
IT IS RECOMMENDED AS A STRICT RULE TO ALWAYS TEST THE JACQUARD DESIGNS BEFORE A POSSIBLE MASSIVE PRODUCTION OR USE.
4. Termination of contract
Should DFT become aware of any unauthorized use, it must revoke the license and terminate the license agreement with immediate effect. In this case, DFT will not be required to refund the license fee and expressly reserves the right to claim damages.
5. Other information and rules
The licensee must inform any subcontractors or collaborators, or employees, of the origin of the drawings and the rules of use or non-use according to the type of license purchased.
Examples of subcontractors may be:
1. second persons from companies outside their own who will work on the design
2. other textile companies which will put the Jacquard designs into production on behalf of the licensee
3. its own external collaborators, employees of its own company, etc.
